1. Acceptance of Terms

By accessing or using the thinkable.ink website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

2. Description of Service

thinkable.ink provides users with tools to generate and manage brand identities. The Service utilizes a credit-based system for accessing certain features. We sell digital products and services only and do not sell physical goods.

3. User Accounts and Data

You are responsible for safeguarding your account information. While we implement security measures to protect your data, you acknowledge that the Service is provided "as is." In the event of any data loss, including but not limited to loss of brand assets, user information, or other generated content, **thinkable.ink shall not be held liable.** You are encouraged to maintain your own backups.

4. Credits and Payments

The Service may require the purchase of "Credits" to use certain features. You are solely responsible for how you use your Credits. **thinkable.ink is not liable for any perceived waste of Credits**, whether due to user error, dissatisfaction with generated content, or any other reason. The interpretation of what constitutes a "waste" of credits is at the user's discretion, but the liability is not on thinkable.ink.

Subscription plans renew automatically on their stated monthly or annual billing cycle until cancelled. Prices are displayed in U.S. dollars unless otherwise stated.

5. Refund and Dispute Policy

Purchases of subscriptions and Credits are generally final and non-refundable, except where a refund is required by applicable law. In exceptional circumstances, thinkable.ink may choose to offer a refund or account credit at its discretion. If you have a question or dispute regarding a charge, contact us within 30 days of purchase.

6. Cancellation Policy

You may cancel an active subscription at any time through the Stripe Billing Portal available from your dashboard, or by contacting customer service if you need assistance. Cancellation takes effect at the end of the current paid billing period. There will be no refunds for unused credits or remaining subscription time, except where required by applicable law.

To request account deletion or a copy of your account data, contact support@thinkable.ink from your account email address. We will verify the request before acting on it.

7. Promotions

Any promotions or offers made available through the Service may be governed by rules that are separate from these Terms. If you participate in any promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a promotion conflict with these Terms, the promotion rules will apply.

8. Legal and Export Restrictions

The Service is subject to United States export laws and regulations. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall thinkable.ink, its affiliates, agents, directors, or employees be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
